These terms and conditions govern your use of the OGIXO platform, a 24/7 breakdown recovery, transportation and vehicle care services portal that connects customers (“Users”) with the service providers (“Service Providers”). By using our services, you agree to these Terms.
1. Definitions
1.1 Platform: The website and/or app operated by OGIXO for the facilitation of 24/7 breakdown recovery, transportation and vehicle care services.
1.2 User: Any person or entity using the Platform to request or book services.
1.3 Service Provider: Any individual or business registered on the Platform to offer 24/7 breakdown recovery, transportation and vehicle care services.
1.4 Booking: An agreement between a User and a Service Provider made through the Platform for 24/7 breakdown recovery, transportation and vehicle care services.
2. Use of the Platform
2.1 Eligibility: Users must be at least 18 years of age to use the Platform.
2.2 Account Creation: Users and Service Providers must provide accurate and complete information when creating an account. Users are responsible for keeping their login credentials secure.
2.3 Platform Role: OGIXO is a facilitator that enables Users to find and book Service Providers. OGIXO is not responsible for the actual services provided by Service Providers.
3. Bookings and Payment
3.1 Booking Process: Users can create a booking request by providing required details, and any specific requirements. Service Providers will respond with quotes, and the User may accept a quote to confirm the booking.
3.2 Payment: Users agree to make payment through the Platform as per the quoted amount. OGIXO may retain a service fee. Payment terms may vary depending on the agreement between the User and Service Provider.
3.3 Service Charges: Users may be required to pay service charges at the time of booking confirmation.
3.4 Cancellations and Refunds: • Users may cancel bookings, but cancellation fees may apply as per the Platform’s cancellation policy. • If a Service Provider cancels, the User may receive a full refund or have the option to rebook with an alternative service provider.
4. User Responsibilities
4.1 Vehicle Condition: Users are responsible for ensuring their vehicle is operable and safe for transport. Users must inform Service Providers of any modifications or specific handling requirements.
4.2 Preparation for Transport: Users must remove personal items from the vehicle prior to transport. The Platform and Service Providers are not liable for loss or damage to personal items left in the vehicle.
4.3 Documentation: Users must provide any necessary documents to facilitate transportation, such as proof of ownership or identification.
5. Service Provider Responsibilities
5.1 Service Quality: Service Providers must carry out services in a professional, safe, and lawful manner, complying with all applicable regulations.
5.2 Insurance: Service Providers must hold valid insurance for the services provided and may be required to show proof of insurance to the User or Platform upon request.
5.3 Adherence to Booking Details: Service Providers agree to adhere to the details specified in the booking unless otherwise agreed upon with the User.
6. Limitations of Liability
6.1 Platform Liability: The Platform is not liable for any damage to vehicles, delays, or service quality issues resulting from the services.
6.2 Service Provider Liability: Service Providers are solely responsible for any loss or damage incurred during the process.
6.3 Limit on Damages: To the fullest extent permitted by law, the Platform’s total liability to any User or Service Provider will not exceed the service fee paid to the Platform for the relevant booking.
7. Insurance and Damage Claims
7.1 Insurance: The Platform does not provide insurance for services. Users and Service Providers are advised to verify that appropriate insurance is in place.
7.2 Damage Reporting: Any claims for damage must be reported to the Service Provider immediately and documented with photographs. The Platform is not liable for resolving damage claims.
8. Dispute Resolution
8.1 Disputes Between Users and Service Providers: The Platform is not responsible for resolving disputes between Users and Service Providers. However, Users may report disputes to the Platform for investigation.
8.2 Mediation Support: At its discretion, the Platform may offer mediation support to facilitate communication between Users and Service Providers, but is under no obligation to do so.
8.3 Governing Law and Jurisdiction: This Agreement is governed by the laws of England and Wales. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Termination of Access
9.1 Suspension or Termination: The Platform reserves the right to suspend or terminate access for any User or Service Provider found to be violating these Terms or engaging in illegal, harmful, or fraudulent conduct.
9.2 Effect of Termination: Upon termination, Users and Service Providers will lose access to their accounts. Outstanding payment obligations and liabilities will survive termination.
10. Privacy and Data Protection
10.1 Data Collection and Use: The Platform collects and uses personal information in accordance with its Privacy Policy, which is incorporated by reference into these Terms.
10.2 Data Sharing with Service Providers: Users agree that certain personal data, such as contact, address and vehicle details, will be shared with Service Providers to facilitate the service.
11. Changes to Terms
11.1 Right to Amend: The Platform reserves the right to modify these Terms at any time. Users and Service Providers will be notified of any significant changes before they take effect.
